1. Service Definition
The "Service" includes the Kawibot suite of applications: KawiLens (Field Data Collection), Baseline (Data Ingestion), Workbench (Engineering Analysis), and Reporter (Report Generation), along with any associated mobile applications and APIs.
2. Professional Responsibility & Disclaimer
Kawibot is a decision-support tool for energy professionals. While we utilize advanced AI and physics-based modeling to provide recommendations:
- No Engineering Stamp: Kawibot does not provide professional engineering sealing or stamping services.
- Verification: You (the Subscriber) are solely responsible for verifying the accuracy, feasibility, and code compliance of all calculations, baselines, and Energy Conservation Measures (ECMs) generated by the Service before implementation.
- Safety: We are not liable for equipment damage, safety hazards, or operational failures resulting from the implementation of recommendations generated by the Service.
3. Data Ownership & Confidentiality
- Your Data: You retain full ownership of all utility bills, production logs, facility photos, and equipment specifications ("Customer Data") uploaded to the Service.
- Confidentiality: We treat your production data (e.g., units produced, specific operational schedules) as strictly confidential.
- Usage for Improvement: You grant Kawibot a non-exclusive license to use anonymized and aggregated data to improve our benchmarking algorithms and AI models. (e.g., "Average chiller efficiency in the Automotive sector).
4. Acceptable Use
You agree not to:
- Reverse engineer the underlying physics engines or AI prompts used in Workbench or Reporter.
- Use the Service to build a competitive energy auditing product.
- Share single-seat login credentials across multiple individuals (Team features should be used for collaboration).
5. Limitation of Liability
To the maximum extent permitted by law, Kawibot's liability for any claims related to the Service (including "Missing Savings" or inaccurate ROI projections) shall not exceed the amount paid by you for the Service during the twelve (12) months prior to the claim.
6. General Terms
Termination: We may suspend or terminate your access if you violate these terms or engage in fraudulent activity.
Changes: We reserve the right to modify these terms, with material changes notified via email or in-app notification.
Governing Law: These terms are governed by the laws of your jurisdiction without regard to conflict of law principles.
